Privacy, Copyright and Use

This page explains how Mingxiang Wang ("I", "me", "my" or the "Artist") handles personal data through the website at https://www.mingxiang.art (the "Site"). It also sets out the copyright, moral-rights, typography and reproduction terms that apply to material published on the Site. It is written for transparency and general information; it does not replace any separate written agreement, artwork sale contract, licence, loan agreement or legal advice.

The Site is a personal portfolio operated by an individual based in London, United Kingdom. It is hosted by Wix.com Ltd. and its affiliates ("Wix").

Privacy and Data Protection

1. Data controller

For the purposes of the UK General Data Protection Regulation ("UK GDPR") and the Data Protection Act 2018, the data controller is Mingxiang Wang. You can contact me through the form on the Connect page at https://www.mingxiang.art/connect.

I do not appoint a data protection officer because this Site is operated as an individual artist portfolio and does not involve large-scale monitoring or special-category data processing.

2. What I collect, and why

I keep data collection to a minimum. I process the following categories of personal data through the Site.

  • Correspondence. When you contact me through a form or by email, I receive the name, email address, message and any attachments or information you choose to send.
    Lawful basis: legitimate interests in responding to your enquiry and, where applicable, steps necessary before entering into a contract.

  • Newsletter. If you subscribe to updates, I receive your email address and, if you provide it, your name.
    Lawful basis: consent. You may unsubscribe at any time using the unsubscribe link in a newsletter email.

  • Visit data, cookies and security logs. Wix may collect standard server logs, device/browser information, IP address, security data, basic analytics and cookies needed to operate, secure and improve the Site. Optional analytics or similar non-essential cookies are used only where consent is obtained through the cookie banner or browser controls.
    Lawful basis: legitimate interests for operation, security and performance; consent for non-essential cookies where required.

  • Sales, loans, commissions, press and licensing. If we discuss or agree the sale, loan, commission, conservation, press use or licensing of a work, I may hold the information necessary to communicate with you, record provenance, issue invoices, arrange shipping or insurance, maintain edition records, and meet tax, accounting or anti-money-laundering obligations where applicable.
    Lawful basis: contract, legal obligation and legitimate interests in documenting, protecting and stewarding the work.

  • Information received from third parties. Occasionally, a curator, collaborator, venue, adviser, collector or public professional source may provide contact or contextual information about you in connection with an enquiry, exhibition, loan, commission or rights request. I use this only for the relevant professional purpose.
    Lawful basis: legitimate interests, contract or legal obligation, depending on the context.

I do not knowingly collect special-category data through the Site. If you choose to include sensitive information in a message, I will use it only as necessary to respond to that message. I do not knowingly collect personal data from children under 13.

I do not use personal data for automated decision-making or profiling that produces legal or similarly significant effects.

3. Retention

  • Enquiries: up to 24 months from last contact, unless an active professional relationship continues.

  • Newsletter records: until you unsubscribe, with a minimal suppression record retained where needed to respect that request.

  • Sales, loan, commission, licensing, accounting and provenance records: at least 7 years where needed for tax and accounting, and longer where necessary to evidence authenticity, edition status, ownership history, conservation history, moral rights or legal title.

  • Legal, copyright and takedown correspondence: as long as needed to resolve the issue and preserve an appropriate record.

  • Wix server logs, analytics and cookie records: according to Wix settings and Wix's applicable privacy documentation.

4. Recipients and international transfers

I do not sell personal data and I do not use it for behavioural advertising. I share personal data only where necessary with:

  • Wix, for hosting, forms, security, analytics, email and site infrastructure;

  • a mailing or newsletter platform, where you have subscribed to updates;

  • payment, accounting, shipping, installation, conservation and insurance providers, where needed for a sale, loan, commission or artwork stewardship;

  • professional advisers, including solicitors and accountants, and competent authorities where required by law;

  • collaborators, curators, venues, institutions or collectors, where you have asked me to make an introduction, where you have consented, or where the sharing is necessary for a project you are involved in.

Some service providers, including Wix, may process personal data outside the United Kingdom. Where this happens, transfers are made using safeguards recognised under UK GDPR, such as an adequacy regulation, the UK International Data Transfer Agreement, the UK Addendum to EU Standard Contractual Clauses, EU Standard Contractual Clauses where relevant, or another lawful transfer mechanism.

5. Your rights

You have the right to request access to your personal data, correction, erasure, restriction of processing and data portability. You also have the right to withdraw consent where processing is based on consent.

Your right to object is specifically brought to your attention: where I rely on legitimate interests, you may object to that processing.

To exercise your rights, contact me through the Connect page. You also have the right to complain to the UK Information Commissioner's Office at https://ico.org.uk.

6. Cookies

Strictly necessary cookies operate the Site, maintain security, hold your session and remember your cookie choices. Optional cookies, including analytics or similar technologies, are used only with your consent where required. You can manage cookies through the Site cookie banner and your browser settings.

7. Security

I rely on the security measures provided by Wix and on reasonable organisational practices to protect personal data. No internet service is perfectly secure. Please do not send confidential or highly sensitive information through unencrypted channels.

8. Confidentiality of collectors and clients

The identity of private collectors, clients, lenders and commissioners is treated as confidential. I do not publish private collector names, private addresses, prices paid or contract terms without written consent. Where a public collection acquires or borrows a work, I may, with appropriate agreement, list the institution, edition number and acquisition or exhibition year for provenance purposes.

On request, I will issue a Certificate of Authenticity, an edition record and conservation guidance for any work acquired directly from me. I keep a private register of editions, sales, loans, condition reports and related correspondence to support provenance, conservation and future exhibition.

Copyright and Use

9. Copyright and moral rights

All material on the Site, including images, photographs, films, video, sound recordings, performance documentation, scores, scripts, texts, drawings, installation views, source files, exhibition documentation, and the layout, structure, selection and arrangement of works, is © Mingxiang Wang, all rights reserved, unless another author or rights holder is credited.

I assert my moral rights to be identified as the author of my works and to object to any derogatory treatment of those works under sections 77 and 80 of the Copyright, Designs and Patents Act 1988, and equivalent provisions in other jurisdictions.

The works are protected as artistic, literary, dramatic, musical, audiovisual and performance works under UK and international copyright law, including the Berne Convention, the WIPO Copyright Treaty and the WIPO Performances and Phonograms Treaty.

10. Permitted use

You may view the Site and download images solely for private, non-commercial reference, for example on a personal device, provided that you do not:

  • remove author credit, watermark or metadata;

  • crop, recolour, retouch, alter, composite or otherwise modify the work;

  • use the material in any commercial, promotional, editorial, AI training, dataset, NFT, blockchain, advertising, fashion, branding, merchandising or product context; or

  • present the work in a way that misrepresents authorship, context, scale, medium, chronology or meaning.

Press, curators, academics and editorial writers may reproduce one low-resolution image to illustrate a review, interview, academic article, event listing or critical text concerning the work or the Artist, provided the credit "© Mingxiang Wang, courtesy the artist" and a link to https://www.mingxiang.art are included. Higher-resolution files, additional images and press materials are available on request through the Press Kit or Connect page.

All other use requires my prior written permission and, where applicable, a written licence on agreed terms. This includes reproduction, distribution, public display, performance, communication to the public, adaptation, translation, scanning, screenshotting for republication, use in datasets and machine-learning ingestion.

11. AI, machine learning and dataset reservation

I expressly reserve all rights in relation to text and data mining, machine learning and dataset creation, including under Article 4 of Directive (EU) 2019/790 on Copyright in the Digital Single Market, the Copyright, Designs and Patents Act 1988, including section 29A where applicable, and any equivalent statute.

I do not consent to the use of any material on this Site, in any format or resolution, for training, fine-tuning, validation, evaluation, retrieval-augmented generation, embedding, feature extraction, model-building, dataset creation, synthetic data generation, or any other ingestion by generative or non-generative artificial intelligence, machine-learning, large-language, computer-vision, audio or multimodal systems.

This reservation is made in this human-readable policy and, where the platform permits, may also be expressed through machine-readable signals such as robots.txt, metadata or TDM reservation protocols. The absence, failure or removal of a technical signal does not waive this reservation. Ordinary search-engine indexing for discovery and standard search snippets is not prohibited, provided it does not involve the creation of AI training datasets or model outputs from the works.

Unauthorised use of material from this Site to train, evaluate or build AI systems, or to compile datasets for those purposes, may be treated as infringement of copyright and database rights.

12. Performance, moving image and likeness

Performance, film and moving-image works on this Site are documented for archival and editorial reference only. Stills, frames, loops, GIFs and re-encodes may not be extracted, reposted or repurposed without written permission.

Where a work depicts collaborators, performers or third parties, additional consent from those individuals may be required before any reuse, including reuse by collectors, publishers, venues or licensors.

13. Third-party material

Third-party photography, video, design, music, writing and typography reproduced on the Site is credited where known and is used with permission, under licence, or under fair dealing for criticism, review, news reporting, quotation or another applicable exception under the Copyright, Designs and Patents Act 1988. If you believe material has been credited incorrectly or used without authorisation, please contact me and I will review, correct or remove it promptly where appropriate.

14. Takedown and infringement

If you believe material on the Site infringes your rights, send a written notice through the Connect page identifying the material, your rights, your contact details and the remedy you request. I respond to credible notices promptly.

I expect the same courtesy in return. Unauthorised reproduction of material from this Site may be addressed through takedown notices, platform reports, invoices for unlicensed use and, where appropriate, proceedings in the courts of England and Wales or another competent jurisdiction.

Acquisition, Resale and Stewardship

15. Terms for collectors and institutions

For collectors and institutions that acquire, borrow or commission a work directly from me or through an authorised representative:

  • Title and risk. Title in the physical work passes only on full payment and delivery, unless otherwise agreed in writing. Copyright does not transfer with ownership of the physical work and is retained by the Artist unless a separate written assignment is signed.

  • Authentication. Each acquired work is supported by a Certificate of Authenticity, an edition record and, where relevant, technical specifications for installation, duration, equipment, media, file format and display conditions.

  • Promotional use by the collector. You may reproduce an image of the work you own, with the credit "© Mingxiang Wang", in personal social-media posts, collection catalogues, insurance schedules, condition reports and non-commercial loan documentation, provided the use is accurate and respectful of the work.

  • Editorial and commercial use. Reproduction in publications, advertisements, merchandise, fashion, packaging, NFTs, digital editions or campaigns requires my prior written permission. I do not unreasonably withhold consent for editorial features about your collection or institution.

  • Resale and provenance. I support resale through reputable galleries, auction houses and art-market professionals. Please notify me of significant transfers so that I can update the provenance record and so statutory Artist's Resale Right arrangements can be administered where they apply.

  • Conservation and migration. Please consult me before restoration, reframing, refabrication, re-editioning, migration to new media, file conversion or replacement of equipment, particularly for performance, moving-image, sound, installation and time-based works.

  • Right of inspection. I may, with reasonable notice and at my own cost, request to inspect or photograph an acquired work for archival, retrospective, conservation, authentication or scholarly purposes.

These provisions protect both the work and the collector. A clear chain of title, a documented edition, a recognised author and a stable conservation history help keep a work valuable, legible and exhibitable over time.

Identity, Typography and General Terms

16. Trade marks and identity

"Mingxiang Wang", "Ming Xiang", the studio identity, wordmark, site identity and visual style of the Site are used as identifiers of the Artist. They may not be used in a way that suggests endorsement, authorship, partnership or affiliation without written permission.

17. Typography, font licensing and acknowledgement

The Site identity and display typography use BBB Sprat from Typothèque BBB / Bye Bye Binary, including BBB Sprat Extended Thin, BBB Sprat Condensed Regular, BBB Sprat Condensed Light and BBB Sprat Regular Light where used in the current Wix theme. BBB Sprat is credited by Typothèque BBB to Eugénie Bidaut, Julie Patard et al., and is based on Sprat, drawn by Ethan Nakache and distributed by Collletttivo.

The type is part of the Site's ethics, not just its appearance. BBB's post-binary typography lets written language hold thresholds, bodies, kinship and address in forms that are unstable, generous and politically alive. That matters to a practice concerned with performance, moving image, queer selfhood and the archive of becoming.

BBB Sprat is used under its published SIL Open Font License (OFL) terms and in the spirit of Typothèque BBB's donation and attribution guidance. I have read the applicable BBB conditions and supported the project with a voluntary donation of approximately €30. Visitors who want to use BBB typefaces should visit https://typotheque.genderfluid.space/fr, read the relevant licence or conditions for the specific font, credit the named designers and support the project at a level appropriate to their means and use.

Font files may be technically served to visitors' browsers only so the Site can render correctly. No right is granted by this Site to extract, copy, host, redistribute, modify or reuse any font file. This acknowledgement is not intended to imply endorsement by Bye Bye Binary, Typothèque BBB, the type designers or Collletttivo.

Supporting body text and technical interface text may use Wix-served, system or open-source fonts for legibility and platform compatibility.

18. Liability and accuracy

The Site is provided in good faith and on an "as is" basis. I do not warrant that information on the Site is current, complete or free from error. Nothing on this page excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot be excluded under English law.

19. Governing law and jurisdiction

These terms, the Site and the works displayed on it are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that I may bring an action to enforce my rights, including copyright, moral rights, database rights and contractual rights, in any competent jurisdiction where the relevant infringement or harm occurred.

20. Changes

I may update this page to reflect changes in law, the Site or my practice. Material changes will be marked by an updated effective date and, where significant, by a notice on the Site or in the newsletter.
